These Terms and Conditions (these "Terms") govern your access to and use of the EasyBear website(s), applications, and related services (collectively, the "Service"). These Terms form a binding agreement between you and EasyBear, Inc. ("EasyBear", "Company", "we", "us", or "our").
PLEASE READ CAREFULLY. These Terms contain an arbitration agreement and a class action waiver in Section 18 that affect your legal rights.
If you do not agree to these Terms, do not use the Service.
1. Our Services; Service Professionals
1.1 How Services Are Delivered
EasyBear provides in‑home appliance repair, diagnostic, installation, and maintenance services (the "Services") through qualified service professionals (each, a "Technician"). Our Technicians operate under the EasyBear brand, adhere to our quality standards, and are vetted through our screening process.
1.2 Company Is Your Service Provider
You acknowledge and agree that:
- When you book through EasyBear, you are engaging EasyBear to provide the Services.
- EasyBear is responsible for ensuring that Services are performed in a professional and workmanlike manner, subject to the limitations in these Terms.
- EasyBear stands behind the quality of the work performed by its Technicians.
1.3 Technician Relationship
Our Technicians are service professionals who perform work under the EasyBear brand. They are required to meet our quality standards, follow our service protocols, and present themselves as EasyBear representatives when performing Services.
2. Definitions
- "Services" means the in‑person diagnostic, repair, installation, or related services performed by a Technician on behalf of EasyBear.
- "Charges" means the price for Services, plus applicable taxes and permitted fees.
- "Service Fees" means fees charged by EasyBear for service-related items (e.g., processing, support, administrative, rescheduling, or cancellation fees), if any.
- "Payment Processor" means a third‑party payment processor used to facilitate payments.
- "Content" means text, photos, videos, messages, reviews, and other materials available on or through the Service.
- "User Content" means Content you submit, upload, publish, transmit, or otherwise make available on or through the Service.
3. Eligibility; Accounts; Electronic Communications
3.1 Eligibility
You must be at least 18 years old (or the age of majority where you live) and have the legal capacity to enter into these Terms.
3.2 Account Registration
You may need an account to use certain features. You agree to provide accurate and complete information and keep your account information current.
3.3 Electronic Communications
By using the Service, you consent to receive communications from EasyBear electronically (e.g., email, in‑app notices). You agree that electronic communications satisfy any legal requirement that such communications be in writing.
4. License; Restrictions; Third‑Party Services
4.1 Limited License
Subject to these Terms, EasyBear grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for your personal or internal business use (for restaurants/property managers) consistent with these Terms.
4.2 Restrictions
You agree not to:
- access or use the Service in any way that violates applicable law;
- reverse engineer, decompile, or attempt to derive source code;
- interfere with security or operation of the Service;
- scrape, harvest, or misuse data;
- use the Service to send unsolicited communications;
- engage in fraud or deceptive conduct.
4.3 Third‑Party Services
The Service may integrate third‑party services (including Payment Processors). Your use of third‑party services may be subject to third‑party terms. EasyBear is not responsible for third‑party services.
5. Booking and Customer Responsibilities; Safety; Data
5.1 Information You Provide
When you request Services, you agree to provide accurate details about:
- appliance type/model, symptoms, and history;
- location, access instructions, and parking;
- known hazards (gas, water leaks, electrical issues, pests, structural risks); and
- any special requirements.
5.2 Safety and Site Conditions
You agree to:
- provide safe, reasonable access to the service location;
- disclose known hazards and unsafe conditions;
- secure pets, valuables, and sensitive areas;
- back up important data (for appliances/devices with data) and secure Wi‑Fi credentials unless required; and
- follow reasonable safety instructions provided by the Technician.
You acknowledge that in‑person repair services can involve inherent risks, including property damage, leaks, electrical hazards, fire hazards, personal injury, and loss of data.
5.3 Commercial Sites
For commercial customers (e.g., restaurants), you are responsible for ensuring your site complies with applicable safety and access requirements (including OSHA-like site practices where applicable) and for designating a responsible on‑site contact.
6. Technician Standards and Vetting
EasyBear maintains quality standards for its Technicians. We verify identity, review licensing and insurance documentation, and may conduct background screening where lawful and available. Our Technicians are required to maintain valid licenses and adequate insurance coverage as a condition of performing Services under the EasyBear brand.

7. Pricing, Estimates, and Transparency
7.1 Upfront Pricing
EasyBear provides upfront pricing for Services. After diagnosis, your Technician will present a quote for your approval before any paid work begins.
7.2 Estimates Are Not Guarantees
Any estimate shown on the Service is informational only and may change based on diagnosis. The Technician must obtain your consent before performing work beyond the agreed scope or price. If the final price exceeds the estimate, you will be notified and must approve the revised price before work proceeds.
7.3 Service Fees
EasyBear may charge Service Fees. If Service Fees apply, EasyBear will disclose them before you confirm payment to the maximum extent practicable. Service Fees may be non‑refundable unless required by law or stated otherwise.
8. Payments; Taxes
8.1 Payment Processing
EasyBear collects payment for Services through a Payment Processor. Payment to EasyBear (or its Payment Processor) constitutes payment for the Services rendered.
8.2 Authorization for Payment Actions
You authorize EasyBear and the Payment Processor to:
- store and charge your payment method for Charges and Service Fees you approve;
- process refunds, credits, or chargeback adjustments as appropriate; and
- share payment status and information necessary to complete the transaction.
8.3 Taxes
Taxes displayed may be estimates. You are responsible for applicable taxes unless prohibited by law.
9. Cancellations, No‑Shows, and Rescheduling
EasyBear may apply cancellation or rescheduling fees (disclosed before confirmation). You agree that if you are not present, do not provide access, or otherwise cause a no‑show, EasyBear may charge fees consistent with disclosed terms.
10. Dispute Resolution and Service Issues
If you are dissatisfied with any Service, EasyBear will work with you to resolve the issue. You may contact us to report concerns, request a re‑repair under warranty, or seek a refund or credit where appropriate.
EasyBear will investigate reported issues and respond within two (2) business days. Depending on the circumstances, EasyBear may offer re‑repair, a partial or full refund, a credit, or another appropriate remedy.

11. Warranty
11.1 90‑Day Warranty
EasyBear provides a 90‑day warranty on Services performed by our Technicians. This warranty covers the same issue addressed in the original Service and the workmanship of the repair. If the same problem recurs within 90 days, EasyBear will re‑repair the issue at no additional charge or, at our discretion, provide a refund or credit.
11.2 Warranty Exclusions
The warranty does not cover:
- new or different issues unrelated to the original Service;
- misuse, abuse, negligence, accidents, improper operation, power surges, water damage, pest damage, or acts of God;
- pre‑existing conditions, undisclosed hazards, or code violations;
- modifications or repairs by third parties after the Service; or
- normal wear and tear.
Parts may have separate manufacturer warranties with their own terms.
11.3 Website Disclaimer
THE EasyBear WEBSITE AND DIGITAL TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, EasyBear DISCLAIMS ALL WARRANTIES REGARDING THE WEBSITE AND DIGITAL TOOLS, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. This disclaimer applies to the digital tools only and does not limit the 90‑day Service warranty described above.
12. User Content; Reviews; License
You are responsible for User Content you submit. You grant EasyBear a worldwide, royalty‑free, sublicensable license to use, host, store, reproduce, modify, publish, and display User Content to operate, improve, and market the Service, including for trust & safety and dispute management.
You agree not to post false, defamatory, infringing, or unlawful content. EasyBear may remove content at any time in its sole discretion.
13. Prohibited Conduct; Fraud; Chargeback Abuse
You agree not to:
- provide false information, conceal hazards, or create unsafe conditions;
- harass or discriminate;
- misuse the Service or attempt unauthorized access;
- engage in fraud; or
- engage in chargeback abuse, including disputing a charge after receiving Services without a good‑faith basis or using chargebacks to bypass our dispute resolution process.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EasyBear WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EasyBear'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO EasyBear FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM OR (II) THE TOTAL FEES YOU PAID TO EasyBear IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY EasyBear'S NEGLIGENCE, (B) FRAUD OR FRAUDULENT MISREPRESENTATION, OR (C) ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.
Some jurisdictions do not allow certain limitations; in those jurisdictions, the above limitations apply to the maximum extent permitted.
15. Indemnification
You agree to indemnify, defend, and hold harmless EasyBear and its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of law; or (d) inaccurate information you provide in connection with Services.
16. Termination; Suspension
EasyBear may suspend or terminate your access to the Service at any time, with or without notice, in EasyBear's sole discretion, to the maximum extent permitted by law. Sections intended to survive termination will survive.
17. Dispute Resolution; Arbitration; Class Action Waiver
17.1 Informal Resolution
Before initiating arbitration, you agree to contact EasyBear to attempt to resolve the dispute informally by emailing legal@easybear-appliancerepair.com and describing the issue and desired resolution.
17.2 Binding Arbitration; FAA
Except for small claims matters and requests for injunctive relief to stop unauthorized use or intellectual property infringement, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this Section.
17.3 Delegation Clause
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this agreement is void or voidable.
17.4 Class Action Waiver
YOU AND EasyBear AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
17.5 Arbitration Opt‑Out (Optional)
You may opt out of this arbitration agreement by sending an email to legal@easybear-appliancerepair.com within 30 days of first accepting these Terms, stating your name, the email/phone used on the Service, and a clear request to opt out. Opting out will not affect other provisions of these Terms.
17.6 Venue; Fees; Rules
If the AAA rules require Company to pay certain fees, Company will do so. The arbitration may be conducted by phone/video unless in‑person is required.
18. Governing Law; Severability; Assignment; Entire Agreement
18.1 Governing Law
Except as preempted by the FAA, Delaware law governs these Terms, without regard to conflict‑of‑law principles, to the maximum extent permitted.
18.2 Severability
If any provision is held unenforceable, the remainder remains in effect.
18.3 Assignment
You may not assign these Terms without EasyBear's consent. EasyBear may assign freely.
18.4 Entire Agreement
These Terms, plus any policies expressly incorporated, are the entire agreement between you and EasyBear regarding the Service.
